Welcome to Mements. These Terms of Use ("Terms") govern your access to and use of the Mements mobile application ("Mements", "App", "we", "us", or "our").

By creating an account or using Mements, you agree to these Terms. If you do not agree with these Terms, please do not use the App.

1. About Mements

Mements is a meme and entertainment platform where users can view images and videos provided by Mements and participate in the community by posting comments.

Mements currently does not allow users to upload images or videos. Images and videos displayed within the App are uploaded or managed by Mements.

Mements is currently provided without advertisements and is not monetized.

Mements may use third-party technical services, including Firebase Crashlytics and Google Analytics for Firebase, to help diagnose crashes, technical errors, and application stability issues.

2. Eligibility

You must be legally permitted to use Mements under the laws applicable to you.

By using Mements, you represent that the information you provide during account creation is accurate and that you are using the App for lawful purposes.

If you are using Mements on behalf of another person or organization, you represent that you have the authority to accept these Terms on their behalf.

3. Your Mements Account

Some features of Mements require you to create an account.

You may create an account using:

You are responsible for maintaining the security of your account and for activity conducted through your account.

You agree not to:

Create an account using false or misleading information.
Impersonate another person or entity.
Create accounts for fraudulent or abusive purposes.
Attempt to access another user's account.
Share or misuse another person's authentication credentials.
Use another person's account without authorization.

We reserve the right to restrict or terminate accounts that violate these Terms or are used for abusive, fraudulent, harmful, or unlawful activity.

4. Comments and User Content

Mements allows users to post comments on content available within the App.

You are responsible for the comments you post.

By submitting a comment, you represent that:

You have the right to post the comment.
The comment does not knowingly violate another person's rights.
The comment complies with these Terms and applicable laws.
The comment does not contain malicious code, malware, or other harmful material.
The comment does not contain content prohibited under Section 5 of these Terms.

You retain any rights you may have in the comments you create.

By posting a comment on Mements, you grant Mements a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that comment within the App and as reasonably necessary to operate, maintain, moderate, and improve Mements.

This license continues for as long as reasonably necessary for these purposes and ends when the applicable comment is deleted, except where retention is required by law or reasonably necessary for legitimate purposes.

5. Prohibited Content and Conduct

Mements is intended to provide an entertaining and respectful community environment.

Mements has no tolerance for objectionable, abusive, or prohibited content or abusive users.

You must not use Mements to post, share, promote, or engage in content or activity that:

Is illegal or promotes illegal activity.
Threatens, harasses, bullies, or intimidates another person.
Contains credible threats of violence.
Promotes or encourages violence or terrorism.
Contains hateful or discriminatory content targeting individuals or groups.
Contains sexually exploitative content.
Sexualizes or exploits minors in any way.
Encourages self-harm or suicide.
Contains malicious software, viruses, or harmful code.
Attempts to scam, defraud, or deceive other users.
Contains spam or excessive unsolicited promotional material.
Impersonates another person, organization, or public figure in a misleading manner.
Infringes copyrights, trademarks, privacy rights, publicity rights, or other intellectual property or legal rights.
Doxes or exposes another person's private or sensitive information without authorization.
Attempts to interfere with, disrupt, reverse engineer, or compromise the App or its infrastructure.
Attempts to gain unauthorized access to accounts, systems, or data.
Attempts to circumvent security, access controls, moderation systems, or technical restrictions.
Otherwise violates applicable laws or these Terms.

We may remove content or take action against accounts when we reasonably believe these rules have been violated.

6. Content Moderation

Mements may review, moderate, restrict, or remove comments and other content that violate these Terms or our Community Guidelines.

We may take action including:

Removing or hiding comments.
Restricting a user's ability to post comments.
Temporarily suspending an account.
Permanently terminating an account.
Restricting access to particular features.
Taking other reasonable measures to protect the Mements community.

We may take action based on reports from users, automated or manual detection, technical systems, or our own review.

We do not guarantee that every piece of content will be reviewed or that every violation will be detected.

7. Reporting Content

Mements provides an in-app reporting feature that allows users to report images, videos, and comments that they believe violate these Terms or contain malicious, harmful, inappropriate, abusive, unlawful, or otherwise prohibited content.

If you encounter content that you believe violates these Terms, you should report it through the App.

Mements will review reported content and determine whether action is appropriate.

If we determine that reported content violates these Terms, applicable law, or our policies, we may remove or restrict access to that content and may take action against the account responsible for it.

Submitting a report does not guarantee that content will be removed. Mements makes moderation decisions at its reasonable discretion.

8. Copyright and Intellectual Property

All images, videos, graphics, branding, logos, design elements, text, and other content provided by Mements, except content that belongs to third parties, are owned by Mements or used with appropriate authorization, licensing, or attribution.

You may not copy, reproduce, distribute, modify, sell, commercially exploit, or otherwise use Mements-owned content without our prior written permission, except where permitted by applicable law.

Where third-party content is used with attribution or permission, the rights remain with the applicable copyright or rights holder.

If you believe that content displayed on Mements infringes your intellectual property rights, you may report it through the App or contact us.

We may remove content that we reasonably believe infringes intellectual property rights.

9. User Comments and Intellectual Property Complaints

If you believe a user comment infringes your copyright or other intellectual property rights, you may report the comment through the App or contact us with information sufficient to identify the content and explain the alleged infringement.

We will review legitimate reports and may remove or restrict access to content where appropriate.

Repeated or serious infringement may result in restrictions or termination of the responsible user's account.

10. Firebase Crash Reporting and Analytics

Mements uses Firebase Crashlytics to detect, record, diagnose, and analyze crashes, errors, and technical problems affecting the App.

Mements may send fatal and non-fatal errors and related diagnostic information to Crashlytics.

Mements also uses Google Analytics for Firebase to provide event and screen information that can be used as breadcrumb information in Crashlytics.

These breadcrumbs may help Mements understand the sequence of screens or interactions that occurred before a crash or technical problem.

When a user is signed in, Mements may associate Crashlytics and Analytics information with the user's Mements/Supabase account identifier for diagnostic purposes.

These services are used for:

Crash reporting.
Error diagnosis.
Technical troubleshooting.
Application stability analysis.
Understanding events or screens preceding a crash.
Improving App reliability and stability.

Mements does not use these services for advertising, targeted advertising, or monetization.

11. Push Notifications

Mements may use Firebase Cloud Messaging (FCM) or other technical services to provide push notifications.

If you enable notifications, Mements may process a device or application-specific notification token and related technical information necessary to deliver notifications.

You may manage notification permissions through your device settings, subject to the capabilities and limitations of your operating system.

12. Account Deletion

Mements provides users with the ability to delete their account directly from within the App. You do not need to contact customer support to request account deletion.

You can use this link to submit an account deletion request. We will review and process the request and delete applicable information from our database, subject to applicable legal requirements and legitimate retention requirements.

When you delete your account:

Your personal account information is deleted from our backend systems.
Your authentication/account information is deleted.
Your profile picture is removed.
Your previously posted comments are deleted and no longer visible to others on Mements.
Your account identifier is removed from your active Mements account.

Please refer to our Privacy Policy for additional information regarding personal information, third-party services, analytics, crash reporting, and account deletion.

Information already processed by independent third-party services, such as Firebase Crashlytics or Google Analytics, may be subject to those services' applicable retention policies and technical processes.

13. Third-Party Authentication

Mements allows account authentication through Apple and Google.

Your use of Sign in with Apple or Google Sign-In may also be subject to the applicable terms and policies of Apple and Google.

Mements is not responsible for the availability, security, or operation of third-party authentication services.

14. Third-Party Services

Mements relies on third-party service providers to provide certain functionality, including authentication, backend services, push notifications, analytics, and crash reporting.

These services may include:

Supabase.
Sign in with Apple.
Google Sign-In.
Firebase Cloud Messaging.
Firebase Crashlytics.
Google Analytics for Firebase.

Your use of third-party services may also be subject to their respective terms and policies.

Mements is not responsible for the independent operation, availability, or policies of third-party services.

Information about how Mements handles information processed through these services is provided in the Mements Privacy Policy.

15. Availability of the App

We aim to keep Mements available and functioning reliably, but we do not guarantee that:

The App will always be available.
The App will operate without interruption.
The App will be completely free of bugs or errors.
All content will always be available.
Features will never be changed, suspended, or discontinued.

We may modify, update, suspend, restrict, or discontinue any part of Mements at any time.

16. Updates

Mements may release updates, bug fixes, security updates, or new features from time to time.

You may need to install updates to continue using certain features of the App.

We may automatically provide updates where supported by your device or operating system.

17. Disclaimer

Mements is provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law.

We make no warranties that Mements will always be available, uninterrupted, secure, accurate, or error-free.

We do not guarantee the accuracy, completeness, reliability, or appropriateness of comments posted by users.

User comments represent the views of the users who post them and do not necessarily represent the views of Mements.

Mements does not guarantee that Firebase Crashlytics or other diagnostic systems will detect every crash, error, or technical problem.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Mements and its owners, operators, developers, employees, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App.

This includes, where permitted by law, losses arising from:

Your use or inability to use Mements.
User-generated comments or interactions.
Content available through the App.
Unauthorized access to an account.
Temporary interruption or unavailability of the App.
Loss of data or content.
Errors, bugs, crashes, or technical problems affecting the App.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Mements and its owners, operators, developers, employees, and affiliates from claims, damages, liabilities, losses, and expenses arising from:

Your violation of these Terms.
Your unlawful use of Mements.
Your comments or other content submitted to the App.
Your violation of another person's rights.
Your misuse of the App.
Your fraudulent, abusive, or unlawful conduct.

This provision applies only to the extent permitted by applicable law.

20. Termination and Suspension

We may suspend, restrict, or terminate your access to Mements if we reasonably believe that you:

Violated these Terms.
Violated our Community Guidelines.
Engaged in fraudulent, abusive, harmful, or unlawful activity.
Misused the App or its infrastructure.
Created a risk to other users or Mements.
Attempted to compromise the security of the App.
Repeatedly posted prohibited content.
Engaged in conduct that threatens the safety or integrity of the Mements community.

Where appropriate and permitted by law, we may provide notice before taking action. However, we may take immediate action where necessary to protect users, the service, or our legal rights.

You may stop using Mements at any time.

21. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may provide notice through the App or other reasonable means.

The updated Terms will become effective when posted unless otherwise stated.

Your continued use of Mements after the updated Terms become effective means that you accept the revised Terms.

22. Governing Law

These Terms will be governed by and interpreted in accordance with the applicable laws of the jurisdiction in which Mements is operated, except where applicable consumer protection or other mandatory laws provide otherwise.

Nothing in these Terms limits any mandatory rights you may have under the laws of your country or region.

23. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will continue in full force and effect.

24. Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the agreement between you and Mements regarding your use of the App, except where additional terms expressly apply to a particular feature or service.
